WAYS & MEANS COMMITTEE UPDATE

 

On Monday, February 14, the House Ways and Means Committee unanimously approved two bills, House Study Bill 78 (now House File 313) and House File 101 (now House File 310).

 House File 313 – Industrial Processing Exemption Study Committee

This bill requires the Iowa Department of Revenue (IDR) to establish a committee to study and make recommendations relating to the sales tax exemption for industrial processing.

 This committee would be comprised of:

  • Representative of the Iowa Department of Revenue
  • Representative of the Iowa Department of Management
  • Industrial producers – including manufacturers, fabricators, printers and other appropriate stakeholders.

 The Industrial Processing Exemption Committee is required to report to the Legislature with their recommendations by January 1 of each year, until January 2013.

Background of House File 313:

 The Industrial Processing Exemption Committee was first established in 2003 in House File 692.  The committee was formed and met a number of times in 2003 and 2004. 

 In June 2004, the Iowa Supreme Court, in the Rants and Iverson v. Vilsack decision, determined that the Governor's action was not proper and eliminated all of the provisions of House File 692.  No action was taken in the special session in September 2004 to reinstate the committee, and thus the committee was formally voided.

 However, the members of the committee did continue to meet on an ad hoc basis.  The committee was converted to a subcommittee of the Iowa Taxpayers Association (ITA).  The committee has identified a number of issues and identified priorities and a method to address the issues.  The committee has been reviewing department rules and the Code of Iowa related to the issues that it identified.  Members of the IDR and the Attorney General's Office continue to be a part of the committee and actively participate in the discussions.  The committee has identified a number of important issues and provides valuable input to the department.

House File 310 – Toys for Tots Sales Tax Exemption

This bill provides for a sales and use tax exemption for purchases of toys made by a nonprofit organization (example:  Marine Corps Toys for Tots Program).  The exemption is for purchases of toys from cash donations the organization has received.  It is expected that this bill will have minimal fiscal impact to the state’s general fund.

ECONOMIC DEVELOPMENT TAKES REGIONAL APPROACH

The House Economic Growth Committee continues to develop its Values Fund proposal as part of a larger state economic growth package.  The Values Fund proposal itself includes a number of programs and initiatives designed to address rural and regional economic development concerns.  Below is a list of proposals contained in the bill that not only address rural concerns, but also attempt to make state regulations easier for businesses to navigate.

 

Regulatory Assistance

Each state agency administering regulatory programs would be required to maintain a business coordinator to serve as a point of contact for all licensing, permitting and regulatory questions businesses may have.  The DED would be required to assist in establishing these coordinators and will direct businesses to the coordinators within the appropriate agencies

Economic Development Regions

Regions within the state would be allowed to organize according to economic interest rather than along city or county lines.  These regional entities would be eligible to receive tax credits and financial assistance, as well as benefit from a regional revenue sharing pilot program

 Economically Isolated areas

In an effort to assist the most rural areas, this bill would allow an area to organize and apply for this classification.  If the area meets the criteria, it may then apply for up to $750,000 over a five-year period for economic development-related assistance.

HOUSE PASSES IRC UPDATE

On Monday, February 14, the House of Representatives unanimously approved House File 186.

House File 186– Internal Revenue Code Update

(IRC) This bill is the annual Internal Revenue Code Update as proposed to the Legislature by the Iowa Department of Revenue.  It includes into Iowa income tax law the federal income tax changes enacted by Congress since 2003.

Some important provisions within HF 186 are:

-Allowing the deduction for contributions to health savings accounts,

-Allowing a deduction for teachers for up to $250 for out-of-pocket classroom expenses,

-Allowing an itemized deduction for contributions made in January, 2005, for relief of victims of the Indian Ocean tsunami to be deducted on the 2004 tax return.

Bills introduced in committee this week:

House Study Bill 19- A Joint Resolution proposing an amendment to the Constitution of the State of Iowa to require approval by vote of the people before certain tax or fee increases take effect.
House File 311 -A bill for an act relating to tax credit certificates issued by the Iowa capital investment board and providing an effective date.
House File 320 -A bill for an act providing that contributions made to certain school tuition organizations may be treated as credits under the individual income tax and including an applicability date provision.
House File 323 -A bill for an act providing for a business property tax credit for property taxes due, making appropriations, and including effective and applicability date provisions.
House File 333 -A bill for an act relating to an individual income tax credit for certain organ transplants and providing a retroactive applicability date.
House File 336 -A bill for an act relating to the repeal of the state inheritance tax and state qualified use inheritance tax.
